  • Application: The software program provided by the Company and downloaded by You on any electronic device, named Total Ink Solutions.
  • Application Store: The digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) through which the Application was downloaded.
  • Account: A unique account created for You to access Our Service or parts of Our Service.
  • Company (referred to as “We,” “Us,” or “Our”): Total Ink Solutions LLC, located at 200 South Newman Street, Unit 5, Hackensack, NJ 07601, United States.
  • Content: Any text, images, or other information posted, uploaded, linked to, or otherwise made available through the Service by You.
  • Country: Refers to New Jersey, United States (unless otherwise specified).
  • Device: Any device that can access the Service, such as a computer, cellphone, or tablet.
  • Goods: Items offered for sale through the Service.
  • Orders: A request by You to purchase Goods from Us.
  • Promotions: Contests, sweepstakes, or other promotions offered through the Service.
  • Service: Refers collectively to the Application and/or the Website.

  • You: The individual, company, or other legal entity accessing or using the Service.

2. Acknowledgment

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, You may not access or use the Service.

  • Age Requirement: You must be at least 18 years old to use this Service.
  • Privacy Policy: Your access to the Service is also conditioned on Your acceptance of Our Privacy Policy, which describes how We collect, use, and disclose Your personal information.

3. Placing Orders for Goods

3.1 Legal Capacity

By placing an Order, You confirm that You are legally capable of entering into a binding contract under applicable laws.

3.2 Required Information

To place an Order, We may require personal details, including:

  • Billing and shipping addresses
  • Payment details

3.3 Order Cancellation by the Company

We reserve the right to refuse or cancel Your Order for reasons including, but not limited to:

  • Product availability
  • Errors in descriptions or prices
  • Suspected fraud or unauthorized transactions
  • Custom items (generally non-cancelable once production starts)
  • Equipment orders (non-cancelable after processing)

3.4 Your Order Cancellation Rights

Your right to cancel applies only to eligible Goods under Our Return and Refund Policy.

  • Refund Timing: Refunds are issued within 14 days of receiving returned Goods.
  • Non-Cancelable Items:
    • Custom-made or personalized items
    • Expired or deteriorated Goods
    • Unsealed hygiene-sensitive Goods
    • Goods inseparably mixed with others
    • All Equipment: Non-refundable once processed

4. Prices & Payments

  • Prices are subject to change before accepting an Order.
  • Accepted payment methods include major credit/debit cards, PayPal, and other approved payment processors.
  • If a payment authorization fails, We shall not be liable for any Order delay or cancellation.

5. Limitation of Liability

To the fullest extent permitted by law:

  • Maximum Liability: Our liability is limited to the amount You paid for the Service in the past 12 months or USD $100 if no purchase was made.
  • We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, lost data).

6. Termination

  • We may terminate or suspend Your access to the Service immediately if You violate these Terms.
  • If You wish to terminate Your Account, discontinue use of the Service.

7. Governing Law

These Terms shall be governed by the laws of New Jersey, United States, without regard to conflict of law principles.

8. Dispute Resolution

  • If You have any disputes, You agree to attempt to resolve them informally by contacting Us first at ink@totalink.com.
  • Unresolved disputes may be submitted to courts in New Jersey, unless applicable consumer laws dictate otherwise.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide 30 days’ notice of material changes. Continued use of the Service after changes are posted constitutes Your acceptance of the updated Terms.
